Terms of Service.

These Terms govern your access to and use of Them AI, provided by Them Labs, Inc. ("Them AI", "we", "us"). By creating an account or using the service, you agree to these Terms on behalf of yourself and, if you are using a workspace for an organization, on behalf of that organization.
The service
Them AI is a research platform for launch decisions. It generates synthetic consumer panels from data you provide, simulates reactions to your questions, supports verification with real humans through your own channels, and calibrates its accuracy against the outcomes you log. Features may change as the product evolves; we will not materially reduce the core service you pay for during a paid term.
Accounts and workspaces
You are responsible for your credentials and for all activity under your account. Workspace owners and admins control who can join their workspace and what roles they hold, and are responsible for their team's use of the service.
Your content and data
You retain ownership of everything you bring to the service - imported data, briefs, questions, and logged outcomes - and of the research outputs generated in your workspace. You grant us a limited license to host and process this content solely to operate the service for you. You are responsible for having the legal right to the data you import: market signals must be lawfully collected, and you must have a lawful basis for any prospect or CRM data you choose to store.
Acceptable use
- Don't use the service to harass, defraud, discriminate unlawfully, or violate the rights of others.
- Don't remove or obscure the AI disclosure when brand twins interact with real people. They identify themselves as AI; keeping it that way is a condition of using the feature.
- Don't present synthetic panel reactions to third parties as research conducted with real humans.
- Don't reverse engineer the service, probe its infrastructure, or attempt to extract its models or prompts.
- Don't resell or white-label the service without a written agreement with us.
Research outputs
Synthetic reactions are predictions, not guarantees. They are designed for pre-spend triage and get more reliable as you log outcomes, but they can be wrong - that is why the product shows confidence intervals and calibration history. You are responsible for the decisions you make with the service, including verifying important calls with real research before committing significant budget.
Credits and payments
Paid plans are billed as described at checkout. Usage is metered in credits - one credit corresponds to one persona reaction in a simulation. Credits consumed by completed simulations are not refundable, except where required by law or when a simulation fails due to a fault on our side, in which case we re-credit them. Unused subscription credits expire as described in your plan.
Beta features
Features marked beta, early access, or "soon" are provided as-is, may change or be withdrawn, and may have separate limits. We appreciate, and may freely use, feedback you give us about them.
Our intellectual property
The service, including its software, models, design, and content we provide, belongs to Them Labs, Inc. and its licensors. These Terms do not grant you any rights to it beyond using the service.
Privacy
Our Privacy Policy explains what we collect and how we use it, including what never reaches model providers. It is part of these Terms.
Termination
You can close your account at any time; deletion follows the retention rules in the Privacy Policy. We may suspend or terminate accounts that violate these Terms, and where practical we will warn you first. If we terminate without cause, we will refund any prepaid fees for the unused part of your term.
Disclaimers and liability
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and our total liability under these Terms is limited to the amounts you paid us in the twelve months before the claim arose.
Changes to these Terms
We may update these Terms as the product and the law evolve. If a change is material, we will notify account owners by email at least 14 days before it takes effect. Continuing to use the service after that date means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and both parties consent to their jurisdiction.
